These Terms of Service (“Terms”) govern your access to and use of PowerTexas.com and the tools, information, resources, and marketplace features we make available through the site (together, the “Services”), operated by Power Texas (“Power Texas,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Power Texas provides tools, information, educational resources, and marketplace features designed to help consumers research and compare electricity options in Texas. Power Texas is a marketplace and information service. It is not an electricity provider, a retail electric provider (REP), or a utility, and it does not generate, transmit, deliver, or sell electricity. Electricity service is provided by the retail electricity providers and utilities you choose, which are separate companies from Power Texas.
You may use the Services for lawful personal or business purposes related to researching and shopping for electricity services. When you enter information into a form or use marketplace features, you agree to provide information that is accurate, current, and complete, and to keep it up to date as needed. You are responsible for your use of the Services and for the information you submit.
Electricity rates, plan availability, fees, contract terms, incentives such as bill credits, and other plan details can change — sometimes frequently — and may be updated by providers at any time. Whether a particular plan is available to you, and on what terms, can depend on factors such as:
Before enrolling in any plan, you should review the provider’s applicable plan documents — including the Electricity Facts Label (EFL), the plan’s Terms of Service, and the Your Rights as a Customer (YRAC) disclosure — along with other information the provider makes available.
While we work to present accurate and current information, the provider’s applicable enrollment documents and agreements ultimately govern the electricity plan you select. We do not guarantee that any rate, price, term, incentive, or savings shown will be available to you or will apply to your account.
Some plan information is shown at standard usage benchmarks (for example, an average price per kilowatt-hour at 1,000 kWh of monthly usage) to help you compare plans. These figures are illustrative and are based on assumptions that may not match your situation. Your actual bill will depend on your real electricity usage, the plan’s pricing structure, charges from your provider and utility, taxes and fees, and other factors, and may differ from any figure shown on the Services.
Electricity providers and transmission and distribution utilities are independent organizations, separate from Power Texas. Power Texas does not control, and is not responsible for, matters handled by your provider or utility, including:
Questions about those matters should be directed to your provider or utility.
Power Texas helps you research and compare plans. As marketplace features become available, the Services may link you to, or connect you with, electricity providers or partners so you can review plan details or enroll in service. Enrollment in an electricity plan is completed with the provider (or a partner acting on the provider’s behalf), not by Power Texas, and is subject to that company’s own terms, conditions, and privacy policy in addition to these Terms. Some enrollment and marketplace features are still being developed; where a feature is not yet available, we will update this section to describe it when it launches.
Electricity for businesses can differ from residential service. Business pricing, eligibility, contract structures, and availability may vary, and may require additional information or customized pricing from a provider. Business electricity inquiries may be handled differently from residential plan shopping, and some business features may not yet be available on the Services.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
You agree to indemnify and hold harmless Power Texas and its officers, employees, and agents from and against reasonable claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of the rights of another person or entity, to the extent permitted by applicable law.

We may update the Services and these Terms from time to time. When we make material changes to these Terms, we will revise the “Last updated” date shown at the top of this page. Changes are effective when posted, and your continued use of the Services after an update takes effect means you accept the revised Terms. We may also modify, add, or remove features of the Services at any time.
These Terms and your use of the Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except to the extent that applicable federal law or the law of your state of residence requires otherwise. Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
